Digital Millennium Copyright Act Compliance

DMCA Policy

At onlinepiano.us, we respect the intellectual property rights of others and expect our users to do the same. We are committed to complying with the Digital Millennium Copyright Act (DMCA) and providing a clear process for copyright holders to report potential infringements. This page outlines our DMCA policy and procedures for submitting copyright infringement notifications.

What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). It criminalizes production and dissemination of technology, devices, or services intended to circumvent measures that control access to copyrighted works. It also criminalizes the act of circumventing an access control, whether or not there is actual infringement of copyright itself. Additionally, the DMCA heightens the penalties for copyright infringement on the Internet.

Our Compliance Commitment

onlinepiano.us is committed to complying with all applicable copyright laws, including the DMCA. We promptly process and respond to notices of alleged copyright infringement and terminate, in appropriate circumstances, users who are repeat infringers. We also accommodate and do not interfere with standard technical measures used by copyright owners to identify and protect their works.

How to Submit a DMCA Takedown Notice

If you believe that content available on or through onlinepiano.us infringes one or more of your copyrights, please send a written notification ("DMCA Takedown Notice") containing the information described below to our designated agent. We will take appropriate action in accordance with the DMCA. Your DMCA Takedown Notice should include:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Procedures

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification to our designated agent containing the following information: (1) Your physical or electronic signature; (2) Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled; (3) A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and (4) Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in the district where you reside, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to onlinepiano.us and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Fair Use and Educational Considerations

onlinepiano.us recognizes that not all unauthorized uses of copyrighted materials constitute infringement. The fair use doctrine permits limited use of copyrighted material without authorization for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. If you believe that your use of copyrighted material on onlinepiano.us constitutes fair use, you may include this information in your counter-notification. However, please be aware that the determination of whether a particular use constitutes fair use is a fact-intensive inquiry that depends on the specific circumstances of each case.

Contact Information for DMCA Notices

Please send all DMCA notices and counter-notifications to our designated copyright agent. Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material or activity is infringing your copyrights.
